These Terms of Service govern the use of rk-store.de and purchases made from RK Store (RK Tech & Print).

Please read them carefully before placing an order.

1. Seller, scope and related policies

These Terms apply to the use of our online store and to contracts for the purchase of goods concluded through it.

The following policies form part of the information provided for purchases from our store:

If a mandatory legal provision provides greater protection for consumers, that provision takes priority over these Terms.

2. Consumers, language and availability of these Terms

A consumer is a natural person acting mainly for purposes outside their trade, business or profession.

These Terms may be made available in German, English and Croatian. The contract language is German unless a different language is expressly identified at checkout.

Where translations differ, the German version prevails to the extent permitted by law. This does not affect mandatory consumer protection rights.

3. Products and product information

We sell smartphones, accessories and 3D-printed products.

Product descriptions, images, technical specifications, compatibility information, prices and availability are displayed on the relevant product page. Please review them carefully before placing an order.

Colours and visual details may appear differently depending on your display, browser or device settings. For 3D-printed products, minor variations in colour, surface texture or visible layer lines may occur as part of the manufacturing process. Such customary variations do not constitute a defect where the agreed characteristics and functionality are not affected.

Some smartphones may be supplied in different regional versions, including China ROM or Global ROM versions. Software, supported languages, network bands, eSIM availability, Android Auto, payment features and other functions may vary by model and version. The relevant product page describes the offered version and known compatibility information. Please check that the product is suitable for your intended use before ordering.

We may correct obvious errors in product descriptions, prices, availability or other information before accepting an order. Statutory rights remain unaffected.

4. Personalised and made-to-order products

For personalised products, you are responsible for ensuring that all names, text, images, designs and other information you provide are correct.

You confirm that you have the necessary rights and permissions to use any material you submit for personalisation. Do not submit unlawful, defamatory, infringing or unnecessary sensitive personal data.

We may decline a personalisation request where its content is unlawful, technically unsuitable, infringes third-party rights or cannot reasonably be produced.

Made-to-order products are not automatically excluded from the statutory right of withdrawal. However, the right of withdrawal may not apply where goods are made to your specifications or clearly personalised in accordance with applicable law. Details are set out in our Right of Withdrawal & Refund Policy.

5. Conclusion of the contract

The presentation of products in our online store does not constitute a binding offer to sell. It is an invitation for you to submit an offer.

Before submitting your order, you can review and correct the information in your shopping cart.

By clicking the button that submits an order with an obligation to pay, you make a binding offer to purchase the products in your cart.

The automatic order receipt sent after your order is submitted confirms that we have received your order. It does not by itself constitute acceptance of your offer.

A contract is concluded when we send you a separate order acceptance confirmation or dispatch confirmation. We normally decide whether to accept an order within five business days.

We may decline an order only where this is reasonable and legally permitted, for example if:

  • the product is unavailable;
  • payment authorisation fails;
  • there is an obvious pricing or product-information error;
  • there are reasonable indications of fraud or unauthorised use; or
  • fulfilment of the order is impossible or unlawful.

If we cannot accept your order after receiving payment, we will notify you and arrange a refund of the amount received without undue delay.

6. Prices, taxes and payment

Unless otherwise stated, the price shown at checkout is the final price for the selected product and destination.

Shipping costs are shown before you submit your order.

RK Store applies the German small-business exemption under Section 19 UStG. VAT is therefore not separately charged or shown. This information will be updated if our tax status changes.

For deliveries to destinations outside the European Union or customs territory, customs duties, import taxes or other import charges may apply. Unless clearly stated otherwise at checkout or required by law, these charges are the responsibility of the recipient.

Available payment methods are displayed at checkout and may include Shopify Payments, PayPal, Klarna, card payments and digital wallets.

Payment is due in accordance with the selected payment method and the terms of the relevant payment provider.

7. Delivery and shipment tracking

Available shipping destinations, processing times, estimated delivery times and shipping costs are shown at checkout and described in our Shipping Policy.

Delivery dates are estimates unless a specific delivery date has been expressly agreed.

If you are a consumer, the risk of accidental loss of or damage to the goods passes to you only when you, or a person you have named who is not the carrier, take physical possession of the goods. This does not apply if you independently commission a carrier that we did not previously offer.

We are not responsible for delays caused by circumstances outside our reasonable control, such as carrier disruptions, customs processing, strikes, extreme weather or other force majeure events. Your statutory rights in the event of an unreasonable delay remain unaffected.

Where tracking is available, we will provide shipment tracking information after dispatch.

8. Cancellation, withdrawal, returns and refunds

Consumers generally have a statutory right of withdrawal for distance contracts.

The conditions, withdrawal period, exclusions, return instructions and model withdrawal form are set out in our Right of Withdrawal & Refund Policy.

Please contact us as soon as possible if you wish to request a change or cancellation. We cannot guarantee changes once an order has been accepted or production of a personalised item has begun.

This does not limit your statutory right of withdrawal or your statutory rights in the event of defective goods.

9. Statutory rights for defective goods and commercial guarantees

Your statutory rights in the event of defective goods remain unaffected. These may include the right to request repair or replacement and, where the legal requirements are met, a price reduction, withdrawal from the contract or damages.

No provision in these Terms limits or excludes statutory consumer rights for defects.

Where a product page or separate guarantee statement expressly offers an additional commercial guarantee, the scope, duration, conditions and guarantor will be stated with that guarantee. Any commercial guarantee is provided in addition to, and does not replace or limit, your statutory rights.

10. Customer accounts and lawful use of the store

If customer accounts are available, you are responsible for keeping your login details confidential and for activity carried out through your account.

You must provide accurate and current information when placing an order or creating an account.

You must not use our store or services to:

  • violate applicable law or third-party rights;
  • interfere with the security, operation or availability of the website;
  • introduce viruses, malware or harmful code;
  • collect data from the website through automated means without permission;
  • impersonate another person;
  • submit fraudulent orders or payment information; or
  • use the website for unsolicited advertising, spam or other abusive conduct.

We may restrict or suspend access to an account where necessary to protect the store, customers or third parties, or where there is a material breach of these Terms. This does not affect existing statutory rights and obligations.

11. Intellectual property

The content of our store, including our logo, texts, graphics, product images, layout and other materials, is protected by applicable intellectual property laws.

You may use the website for personal and lawful shopping purposes only. You must not copy, reproduce, distribute, modify, publish, sell or exploit store content without prior written permission, except where permitted by law.

Product names, trademarks and logos belonging to third parties remain the property of their respective owners.

12. Third-party services and Shopify

Our store is powered by Shopify. Your contract for the purchase of products is concluded directly with RK Store (RK Tech & Print), not with Shopify.

Shopify provides the technical platform used to operate the store. Shopify is not responsible for the sale, delivery, quality, return or refund of products purchased from RK Store, except where mandatory law provides otherwise.

Our website may contain links to third-party websites or services. We are not responsible for the content, availability or privacy practices of third-party websites. Please review their terms and privacy notices before using them.

13. Privacy

The processing of personal data is governed by our Privacy Policy.

Using our website does not itself constitute consent to every form of data processing. Where consent is required, for example for optional cookies, analytics or marketing, we request it separately.

14. Liability

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under mandatory product-liability law, in the event of fraudulent concealment of a defect, and where we have expressly assumed a guarantee.

In the event of simple negligence, we are liable only for the breach of an essential contractual obligation. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment you may normally rely.

In such cases, liability is limited to the foreseeable damage typically occurring under the contract.

Any further liability for simple negligence is excluded to the extent permitted by law.

Nothing in these Terms limits rights that cannot legally be excluded or restricted.

15. Governing law and jurisdiction

These Terms and purchase contracts are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer habitually resident outside Germany, you continue to benefit from mandatory consumer protection provisions of the country in which you have your habitual residence.

Statutory rules on jurisdiction remain unaffected.

16. Changes to these Terms

We may update these Terms where necessary due to legal changes, changes to our services, technical developments or other legitimate reasons.

Changes apply prospectively. Orders already accepted remain governed by the Terms in force at the time the contract was concluded, unless a legal requirement provides otherwise.

Where required by law, we will provide notice of material changes before they take effect.

17. Severability

If any provision of these Terms is invalid, unlawful or unenforceable, the remaining provisions remain effective.

The applicable statutory provision will apply in place of any invalid or unenforceable provision.
